A new report,The New York Times,found that the pharmaceutical giant Pfizer is facing a legal battle with a California law requiring the disclosure of Viagra sales data on the Internet.
The new law, passed by the State Board of Pharmacy, says a person who sells a prescription drug on the Internet for the purpose of selling it without a valid prescription must not make the prescription for which the drug was manufactured.
It also requires a drug’s manufacturer to prove that it has a valid medical record to sell it and the doctor has the necessary knowledge to know how much the drug is being sold.
The bill, which passed the Legislature in January, would allow a doctor to make a prescription for a drug sold on the Internet without requiring the drug to be made available.
The California law is meant to prevent a person from selling a drug that is in a class of drugs called off-label, or “off-label” drugs, that is not approved by the Food and Drug Administration (FDA).
The bill would not protect an individual who sells a prescription drug on the Internet without a valid prescription.
“The Internet is an incredibly popular and important way for drug sales to happen, and if you can’t afford to pay for the drugs, you can’t afford to have a doctor visit you,” said Amy Tovatch, director of public relations for Pfizer.
The legislation also would require that the FDA’s approval process for off-label sales of prescription drugs will include an “approved use” requirement, in which the FDA would require the company to prove that a drug’s sales data and manufacturing process meets the drug’s approved use requirements and to prove that the drug is approved.
The bill requires the FDA to conduct a “consultation with a doctor,” or “consultation” to evaluate a person’s medical history, including a history of serious health problems, when a person makes a prescription for a drug.
“This bill is a perfect storm for the pharmaceutical industry,” said Bill Weil, president of the California Pharmacists Association, which represents the pharmaceutical industry.
“It’s an unfortunate consequence of the past,” he said.
The bill was signed by Gov. Arnold Schwarzenegger and passed the Legislature in January.
The state’s bill, which also is part of a bill that was introduced in March, is scheduled to be introduced into the Legislature on June 18.
